Mr. Stover contested <br />the fact of the violation. He explained that the mine is inactive, and <br />therefore, there is no waste currently being placed on the pile. He felt the <br />pile is not currently under construction, and because of that, he did not <br />believe quarterly certifications were needed. <br />I feel a violation did exist. Although no additional waste material was being <br />placed on the pile, I consider it under construction until the pile has been <br />successfully revegetated. An inspection was conducted <br />the same day and the certification was sent to the Division. I feel this is <br />the shortest time possible and represents an extraordinary effort by the <br />operator.
