Please note <br />that since the revision states, "The area disturbed at any one time during <br />mining will also remain the same", the operator is still limited to 14.2 acres <br />of mining disturbance and a total of 21.7 acres of major and moderate <br />disturbance at any one time, as described in Exhibit D - Mining Plan of the <br />original approved application. Concurrent grading, topsoiling, and seeding <br />must continue as before. The only difference is that you are no longer <br />required to mine only in one of the previously approved 8 phases at a time; <br />you may now mine in any part of the new Phase 1 or Phase 2 (once Phase 1 is <br />reclaimed), as long as you do not exceed the 21.7 acres of major and moderate <br />disturbance. <br />If you plan to exceed this acreage of disturbance a change to the permit <br />(technical revision or amendment) will need to be approved and a new financial <br />warranty would have to be calculated. <br />The terms of the TR No. 001 approved by the Division are hereby incorporated <br />into Permit No. M-92-069.
