Please note
that since the revision states, "The area disturbed at any one time during
mining will also remain the same", the operator is still limited to 14.2 acres
of mining disturbance and a total of 21.7 acres of major and moderate
disturbance at any one time, as described in Exhibit D - Mining Plan of the
original approved application. Concurrent grading, topsoiling, and seeding
must continue as before. The only difference is that you are no longer
required to mine only in one of the previously approved 8 phases at a time;
you may now mine in any part of the new Phase 1 or Phase 2 (once Phase 1 is
reclaimed), as long as you do not exceed the 21.7 acres of major and moderate
disturbance.
If you plan to exceed this acreage of disturbance a change to the permit
(technical revision or amendment) will need to be approved and a new financial
warranty would have to be calculated.
The terms of the TR No. 001 approved by the Division are hereby incorporated
into Permit No. M-92-069. All other conditions and requirements of Permit No.
M-92-069 remain in full force and effect.
If you have any questions, please contact me.
Sincerely,
Gregg Squire
J~ ~
Envil-onmental Protection Specialist
COLORADO
cc: Pam Acre, Tuttle Applegate, Inc.
