~ ~ III IIIIIIIIIIIIIIII <br />STATE OF COLORADO <br />Roy Romer, Governor ~ - <br />DEPARTMENT OF NATURAL RESOURCES W <br />MINED LAND RECLAMATION DIVISION <br />DAVID C, SHELTON, Director <br />April 30, 1987 <br />Mr. Clinton Williams <br />C & C Sand Company <br />2635 Steel Drive <br />Colorado Springs, Colorado 80907 <br />Re: Red Canyon Quarry Mine; File No. M-85-043 <br />Dear Mr. Williams: <br />On April 14, 1987 we conducted an inspection of your mine and found: <br />disturbance to Red Creek, sediment control problems, off-site damage and possible <br />disturbance outside the permit boundary. <br />We believe this is in violation of: <br />C.R.S. 34-32-116(b), 34-32-116(i), 34-32-116(j), <br />Therefore, we have found reason to believe a violation exists to Permit M-85-043 <br />and the Law and have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the May 27-28, 1987 Board meeting for <br />consideration of possible violation. The hearing will be held in Room ]10 of 7313 <br />Sherman Street, Denver, Colorado, beginning at 9:00 a. m. or as soon thereafter as <br />the matter can be considered and you will have the opportunity to be represented <br />and heard. It will be reiterated that there is reason to believe that you are in <br />violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist <br />order, assess a civil penalty in the amount of $100.00 to $1,000.00 <br />for each day of violation or order the permit he suspended, modified or revoked, <br />1n addition it may set the matter for consideration of forfeiture of the $11,000.00 <br />financial warranty at a subsequent hearing.
