Box 535 <br />Somerset, CO 81434 <br />Re: Somerset/Sanborn Creek Mine, Permit No. C-81-022 <br />NOV C-94-007 <br />Dear Mr. Wright: <br />I~~ <br />DEPARTMENT OI <br />NATURAI <br />RESOURCE` <br />Foy Rnmer <br />cuverno~ <br />Ken Salazar <br />Etccuuve Direaoi <br />Michael B Long <br />Dirls~on Direao~ <br />Upon review of inspection reports, aerial photographs, and weather conditions in the North Fork <br />Valley during January and February 1994, the Division has determined that Somerset Mining <br />Company's lack of due diligence in performing hydrologic monitoring required by Permit <br />No. C-81-022 is a violation of the Rules of the Colorado Mined Land Reclamation Board for Coal <br />Mining. See enclosed Notice of Violation. <br />Abatement for this violation requires SMC to submit to the Division, and obtain approval for, a <br />minor revision addressing measures SMC will take in the future to ensure, to the extent feasible, <br />that required hydrologic monitoring is conducted. The Division would be happy to meet with <br />you and discuss possible measures. The abatement also requires that the revision include <br />conditions which SMC would consider preclude sampling according to the permit. This may <br />need to be addressed on a site-by-site basis. Again, the Division would be happy to discuss <br />with you conditions which we feel sampling is no longer feasible. <br />The Division does not feel that conditions described in a letter from J.E. Stover and Associates <br />(consultant to SMC) dated March 31, 1994, were bad enough to preclude required hydrologic <br />monitoring of groundwater wells SC-1, SC-2, SC-3 and surface water monitoring sites NF-1 and <br />NF-2. <br />Please contact me if you would like to discuss the conditions of the violation abatement. <br />Sincerely, <br />Steve S.
