My name is Brad Janes, Reclamation Specialist, this is Item <br />Number 43, Weld County Department of Engineering, File No. 80-149. <br />Application for a regular impact permit for an open pit sand and gravel <br />operation located approximately one mile east of Interstate 25 along <br />the St. Vrain Creek, northeast of Longmont, Colorado, and affecting <br />7 <br />,~ <br />approximately 231.9 Acres. Before I go any further, I think we should <br />talk about County Zoning here because I have had some conflicting <br />.' information just recently. I had the understanding that County Zoning <br />approval had been obtained and I called this morning around 12:00 o'clock <br />to verify whether or not that actually had occurred. I understand, <br />the County told me that the County Commissioners have not met [o consider <br />7 <br />~ ~ this application, in fact they have not even received the papers on it <br />and in fact the only persons who has seen this is the County Planning, <br />the County Planning people. <br />DAVE SHELTON: Why don't we go right to the County Attorney and ask him what he has to say? <br />THOMAS DAVID:The Planning Commission is the only authority that can grant a Special Use <br />Permit, the governing body of the County can overrule the Planning Commission <br />or the governing body of the entity represented. But if the approval is <br />obtained at the Planning Commission level, according to the statute of the <br />State of Colorado, that's it. <br />BRAD DANES: Ok, I just wanted to get clarification on that because the Planning Commission <br />letter that I have received says, open cut mining operations are reviewed as <br />Special Use Permits, review requirements as to special use permits be reviewed <br />for compatibility with the area, harmony, etc. I called the County Commissioners <br />about why it does not go to the County Commissioners, it won't go to the <br />Commissioners for a while, they haven't received the papers yet, that's all <br />I know. <br />THOMAS DAVID:Ordinarily a special use permit goes to through the Planning Commission for <br />advisory opinion and then goes to the Board of County Commissioners for issuance. <br />However, when the County itself is an applicant, it goes only to the Planning <br />Commission, the same being true, say Greeley now has a special use permit <br />application for waste water. In the event that the Planning Commission approves <br />it, that's it. If they deny it, then 1t goes to the City Council and the <br />
