Frei Albert Frei & Sons, Inc. 8400 Holly Street Henderson, Colorado 80640 Re: Frei Pit No. 3 - File No. M-79-165 Dear Mr. Frei : On December 17, 1986, our Division received the $350.00 annual fee and annual report for the above captioned operation. Therefore, I will plan to recommend to the Mined Land Reclamation Board during the upcoming December 18-19, 1986 meeting that the formal public hearing to consider a possible violation against your company for failure to submit these required items be withdrawn. Unless you hear from me to the contrary, you may presume that the Board approved this recommendation. Please take note of the October 25th anniversary date of your permit for this operation and submit your annual fee and report on or before that date next year. Please be advised that our Rules and Regulations require that reclamation be completed within five years of the completion of mining. Therefore, unless you can commence reclamation as per the approved permit quite soon, I suggest that the procedure to officially transform this site into a landfill be expedited (by your company, if necessary).
