Basin does net dispute all of the statements made in Plaintiffs' Status Report, but <br />findsit necessary to correctthe record on certain points. <br />2. Basin will not address PlainGfta' account of the administrative proceedings. <br />Basin denies Plaintitl's' allegation that Basin is "wholly owned and operated' by <br />Westmoreland Coal Company ("Westmoreland"}. {Status Rep.'g 4,) Basin also <br />denies Plaintiti`s' allegations that Westmoreland is "liable" for Basin and that it <br />"assumed all assets and liabilities of Basin Resources, Inc," in 2001. {!d.) <br />Wesnnoreland purchased Basin's stack, not its assets or liabilities, on April 30, <br />2V01.
