-= <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN 7HE MATTER OF: C & C Sand Company ) NOTICE OF VIOLATION M-87-034 <br />AND <br />CEASE AND DESIST ORDER <br />T0: Mr. Clinton Williams and all other persons engaged in or owning or <br />controlling the following operation: C & C Sand Company, Red Canyon Quarry <br />FINDINGS OF FACT <br /> <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: _. <br />1. C & C Sand Compnay is permitted to conduct a mining operation under the <br />teens of Permit M-85-043 located in Section(s) 1, Township 175, Range 68W of <br />the 6th P,M., in Fremont County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on May <br />27, 1987 to consider possible violation of the terms of Permit M-85-043 and <br />C.R.S. 34-32-101 et sew <br />3. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on May 27, 1987, demonstrating that: <br />1. The operator has failed to protect Red Creek from disturbance. <br />2. The operator has failed to control sediment transport and off-site <br />damage. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />C & C Sand Company to be in violation of Permit M-85-043, specifically <br />Exhibits D and G, and C.R.S. 34-32-116(h), 116(i), 116 0 ). <br />
