Cerise and desist from conducting the following mining operations at the <br />Lamar Pit - Permit M-87-079: on the areas outside of the permit area, <br />exr:ept that equipment and stockpiles may be removed. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective actions: <br />a. Submit an application to the Division for conversion of the <br />existing 110 permit to a 112 permit, on or before the existing date <br />of June 27, 1994. <br />b. Mark all permit boundaries and provide evidence to the Division of <br />such marking on or before the date of May 28, 1994. <br />4. Pa)~ the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of $100.00, within 30 days of the signature date of this <br />document. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />~'\. <br />Dated at Denver this ci7 day of ~~ ,~~ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />'~'I;NAEL 6.
