Long, <br />Division Dveclar <br />On June 9, 1992, we conducl:ed an inspection of your mine and found evidence of quarrying of <br />surface moss rock in an area for which you had not established proper right-of-entry and in an area <br />outside of your permit area. <br />We believe these are i,l violation of Sections 34-32-1101711c1 and, by reference, 34-32-112121(dl <br />together with Sections 34-3 2-1 1 61711h1 and 34-32-12416) of the Colorado Mined Land Reclamation <br />Act 34-32-101 et se . C.R.S. 1973 as amended. <br />Therefore, we have found reason to believe violations exist to Permit M-90-016 and the Law and have <br />scheduled this matter before thr~ Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the August 26-27, 1992 Board meeting for consideration <br />of possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, <br />Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will <br />have the opportunity to be represented and heard. It will be reiterated that there is reason to believe <br />that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a civil <br />penalty in the amount of 550.00 to S200.00 for each day of violation, or order the permit suspended, <br />modified or revoked.
