2. Will the Applicant comply with applicable Colorado water laws and regulations governing injury to <br />existing water rights for neighboring water wells? (Water Information, Rule 3.1,6(1)(a)) <br />DMG Response - On October 5, the applicant provided evidence of an approved well permit from the <br />Office of the State Engineer for de-watering and other mining activities. Issuance of the well permit <br />verifies the applicant is and will be in compliance with applicable Colorado water laws and regulations <br />governing injury to existing water rights for neighboring water wells, and with Constmction Materials Rule <br />3.1.6(1)(a). <br />3. Has the Applicant provided a statement identifying which pemrits, licenses and approvals they will be <br />seeking in order to conduct the proposed mining operation? (Rule 6.4.13) <br />DMG Response -The applicant has provided a list of other permits and licenses obtained for the Durham <br />Pit in Exhibit M of the amendment application and again in the 2°d and 3~ adequacy responses on August <br />4, 2004 and October 5, 2004. The applicant has provided a comprehensive inventory of other pemrits and <br />licenses obtained for the Durham Pit that comprise total nine (9) permits and licenses. The Division is not <br />awaze of any additional permits or licenses necessary to conduct the proposed operation. <br />III. DIVISION RECOMMENDATION <br />Based on our review of thepennit application and all supportine documentation, the Division recommends <br />conditional approval of the Reeulaz 112 Amendment Application, with a financial warranty requirement of <br />$300,000. The conditions of approval for this amendment application aze as follows: <br />Stipulation 1 : "The aerator will cease any,further addition of~ill material within the designated <br />floodwa~the Cache La Poudre River unless authorized by the designated local. state. andjederal flood <br />control authorities. ie: Weld County Colorado Water Conservation Board and FEMA. The "addition of <br />fill material" includes the addition ofanv earth materials that result in an increase in the height width <br />or length of the existint+flaod control berm. " <br />Stipulation 2 ; "Any future modifications to the present configuration of the ezistingflood control berm <br />must not be contrary to the laws or rentlaSons ofthe designated local. state and federal /load control <br />authorities ie Weld County,_Colorado Water Conservation Board. and FEMA,. " <br />
