Rationale for Recommendation of Conditional Approval, Over Objections <br />Regular 112 Construction Materials Amendment Application <br />Durham Pit, Permit No. M-1978-056 <br />Varra Companies, Inc. <br />Introduction <br />Varra Companies Inc. submitted a complete application for a Regulaz 112 Amendment on November 13, <br />2003 to update the mining and reclamation plan for the Durham Pit and to bring the permit into compliance <br />with current Construction Materials Rules and Regulations. Due to objections received during the public <br />comment period apre-Heazing Conference was held on January 30, 2004. On October 13, 2004 the <br />Division issued a recommendation of approval of the application, over objections. The Durham Pit is <br />located at 1431 East 16`" Street, immediately east of the City Limits of Greeley, and is bordered on the <br />north by the Cacfie La Poudre River. The pemtit azea is Located in the NW 1/4 of the NW 1/4 of Section 1Q, <br />TSN, R65 W, 6`" P.M. A total of 229.89 acres will be permitted. The site will be de-watered and dry mined <br />using conventional mining equipment. The depth of excavation is expected to average 25 feet below <br />ground surface, with a maximum depth of excavation of 40 feet below ground surface. Alluvial <br />groundwater was expected to have been approximately 8' below the ground surface, prior to mining <br />disturbance. The site has a history of mining disturbance that spans over 30 yeazs. At the time of original <br />pemtitting in 1978, the site contained apre-existing flood control berm Since then, the size and extent of <br />the berm has been modified by at least three (3) different operators. The Durham Pit will be reclaimed to <br />industria]/commercial use along with 2 unlined ponds of 128 and 7 acres in size. Surrounding azeas will be <br />topsofled and re-vegetated with a grass mix. The Division has calculated a total reclamation cost of <br />$300,000 for the 185.23 acres of affected land. <br />I, OBJECTIONS: <br />The Division received objections from the following individuals during the public comment period. <br />Objector Date Received Concerns Noted <br />Kevin & Shazon Cazbaugh 12/17/03 Impacts to their groundwater well, fugitive dust <br />City of Greeley 12/16/03 Placement of fill in a designated floodway & <br /> potential adverse offsite impacts to stmctures <br />Robert & Michael Bliss 12/19/04 Placement of fill in a designated floodway, not <br /> in compliance with pernut conditions & potential <br /> adverse offsite impacts to structures; and <br /> adverse impacts to Bliss groundwater wells. <br />
