As noted in the violation assessment <br />conference, Picketwve Processing and New Elk Coal Company were actively pursuing an adequate letter of <br />credit and/or surety bond to comply with the Bonding requvement for the New Elk Mine prior to and after <br />issuance of the violation. <br />Subsequent to the issuance of the violation, both companies and potential bonding agents kept the Division <br />updated relative to progress regazding the issuance of the requved bond. Regulations permit the Division to <br />issue extensions, if wan•anted,pf up to ninety days for abatement of a violation. Given the diligent pursuit <br />of adequate bonding by PPLLC and NECC and the submittal of adequate bonding to the Division prior to <br />the end of the ninety day period, the closure order should be vacated. <br />Your consideration of this request is appreciated.
