An assessment <br />conference was held at the Division's office on November 16, <br />1993. In attendance at the conference, in addition to yourself <br />and me, were Susan Burgmaier representing the Division and Tom <br />Wainwright and Chuck McCullen representing Peabody Western Coal <br />Company. If you agree with the penalty, please sign the <br />settlement agreement within ten (10) days as instructed on the <br />form. If you disagree with the settlement agreement, do not sign <br />it. The Division will fix the penalty pursuant to Rule 5.04.3(5) <br />and you may request a Board Hearing.
