The mine is operated by the New <br />Castle Energy Corporaticn. <br />We request this action because of the conditions and practices <br />described below which we believe have resulted in violations. We <br />have listed the requirements of the Colorado rules believed to <br />apply. <br />1. New Castle Energy Corporation disturbed land by building and <br />removing the pump house and a section of the water supply <br />pipeline outside the approved permit area. No reclamation plan <br />and bond exist on this area. The mine operator also constructed <br />a section of the pipeline within the permit area and such <br />facility was not approved under its permit. Conducting surface <br />coal mining operations without a permit: C.R.S. 34-33-109(1) and <br />Rule 2.01.3(1). <br />2. The existing permit package does not address the section of <br />the pipeline located on the permit area, how this disturbed land <br />will be reclaimed and the removal of the pipeline subsequent to <br />mining. Nor were the costs of reclamation and removal calculated <br />in the existing performance bond. Failure to submit an <br />application meeting the standards of Rules 2.05.3(2)(b) and <br />(3)(a); 3.02.1 and 3.02.2 <br />3. The pipeline runs through a culvert under County Road 335. <br />Locating the pipeline in this manner reduces the ability of the <br />culvert to convey the amount of water it was sized for and <br />presents a risk of catching debris, thus further reducing the <br />effective capacity of the culvert or blocking it ...
