Long <br />Drvi.iun Dvecun <br />Please find attached, Colowyo Coal Company's request to extend the abatement deadline <br />beyond 90 days for NOV C-95-026. The violation was issued December 5, 1995. The 90 <br />day period ends March 2, 1996. Abatement requirements for the violation include seeding <br />the windrow piles in accordance with the permit, place topsoil signs on all piles and <br />redistribute the windrow piles on the reclaimed area as required in the permit. The <br />windrow piles have been seeded with a temporary seed mix, and topsoil signs have been <br />placed on the piles. The windrow topsoil piles have not been redistributed on the backfilled <br />areas due to weather and ground conditions. <br />Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension <br />of the abatement of deadline beyond 90 days. Weather conditions is one of the qualifying <br />circumstances for extending the deadline.
