Long
Drvi.iun Dvecun
Please find attached, Colowyo Coal Company's request to extend the abatement deadline
beyond 90 days for NOV C-95-026. The violation was issued December 5, 1995. The 90
day period ends March 2, 1996. Abatement requirements for the violation include seeding
the windrow piles in accordance with the permit, place topsoil signs on all piles and
redistribute the windrow piles on the reclaimed area as required in the permit. The
windrow piles have been seeded with a temporary seed mix, and topsoil signs have been
placed on the piles. The windrow topsoil piles have not been redistributed on the backfilled
areas due to weather and ground conditions.
Rule 5.03.2(2)(c) list five circumstances which may qualify a surface coal mine for extension
of the abatement of deadline beyond 90 days. Weather conditions is one of the qualifying
circumstances for extending the deadline. I recommend approval of the abatement dateline
to May 31, 1996.
Enclosure
c: \wp51 \colowyo\960228
