III IIIIIIIIIIIIIIII <br />999 <br />Memorandum <br />To: Dave Berry <br />From: Janet Binns (~~( <br />Date: 2/07/01 <br />Re: Sunland Mining Corp, Apex No. 2 Mine, C-81-011, NOV CV-2001-001 <br />File: C:/jhb/C81011/NOV CV2001001 <br />CC: Dan Hernandez <br />Please review the attached NOV for the Sunland Mining Corp. Apex No. 2 Mine for penalty assessment. <br />The NOV was issued on January 26, 2001 for failure to maintain public records. The mine is a small <br />underground reclaimed mine in Routt County. There aze no facilities remaining at the site and no mine <br />personnel in the area. The operator is located in West Virginia but the site and records aze maintained by a <br />consultant in Highlands Ranch, Colorado. <br />The Division noted in inspections dated February 24, 2000, May 10, 2000, July 17, 2000, and October 19, <br />2000 that insurance document needed to be updated in the courthouse records and current DMG inspection <br />reports were not on file at the Routt County Courthouse. On January 22, 2001, the Division conducted a <br />complete inspection of the Apex No. 2 Mine, which included an inspection of the public records stored at <br />the courthouse. No evidence was found to verify that the missing records had been sent to the courthouse. <br />NOV CV-2001-001 was issued as a result, for failure to maintain mine records. <br />The consultant was notified but he was not available. Upon the consultant's return, he indicated that he had <br />mailed the missing inspection reports to the Routt County Courthouse on October 31, 2000, and mailed <br />DMR's and sediment pond inspection reports to the Routt County Courthouse on December 13, 2000. He <br />did not have copies of cover letters or verification of receipt from the County Clerk and Recorder but he has <br />submitted a photocopy of his billable hour logbook as evidence. The consultant never received a copy of <br />the current insurance document from the insurance company so was unable to forwazd that information to <br />the public files. The Division faxed a copy of the current insurance form to the consultant on January 29, <br />2001. The consultant was out of state and did not return until late night January 30, 2001. The consultant <br />sent the missing information to Routt County Clerk and Recorder on January 3I, 2001. The consultant <br />received an e-mail verification from the Routt County Deputy Clerk on February 1, 2001 that the <br />information was received and had been placed in the proper file. The consultant faxed evidence of these <br />submittals and an explanation letter on February 6, 2001. <br />Should you have any additional question or need to review the Apex files, please feel free to ask me for <br />assistance. <br />
