The following information is being submitted on behalf of our client, Jake Kauffrnan & Son, Inc.
The Wagner/Kauffman Pit #3 mining operation (M-99-069) is located mainly in the Northwest''/4
of the Northwest'/< of Section 21, Township 5 North, Range 68 West of the 6~' P.M. The site is
located in Lazimer County approximately 1.5 miles east of Loveland, Colorado.
Phase I of the mining operation covers the east half of the permit area, with approximately 66
total acres being mined. Mining in Phase I is essentially complete. Reclamation activities have
been concurrent with mining and approximately"47 acres of Phase I have been backfilled and
revegetated consistent with Exhibit E, Reclamation Plan, of the Reclamation Permit Application.
Jake Kauffman & Son, Inc. is requesting release of the permit area for the reclamation activities
completed. A reduction in the permit financial warranty is NOT being requested. The affected
area has been backfilled, graded, and revegetated consistent with Exhibit E of the Reclamation
Permit Application. All backfilling and grading activities on the 47-acre portion of the site were
done as mining progressed. Final grading was fmished in 2003 after mining operations were
completed and revegetation of the site was performed in Fa112003 and Spring 2004, The owner
chose to seed the affected area with pasture grasses consistent with the final land use, and the
vegetative cover is presently doing well.
In compliance with Subsections 3.1.1 through 3.1.4 of Section 3.1, Reclamation Performance
Standards, Construction Material Rules and Regulations, apost-mining land use was established
for the site, approved by the Office, and a reclamation plan was formulated. As stated in
Exhibit E of the Reclamation Permit Application, the final reclamation plan for this portion of
the site was to return the disturbed ground to pastureland and to match the reclaimed grade of the
property to the pre-existing grade. Consistent with Exhibit E, backfilling of the mined pit and
