,_. 1' • • <br />NOV C-96-012 <br />Foidel Creek Mine <br />This NOV was issued for failure to construct and maintain approved surface runoff control <br />structures at the No. 7 North Escape Shaft. <br />HISTORY <br />Three NOV's have been issued at this mine during the past twelve months. They are NOV's <br />C-96-001, 002 and 003. $150 is assessed for history. <br />SERIOUSNESS <br />This violation resulted in deposition of several cubic yards of material outside of the <br />permitted disturbed area for the mine as a result of some significantly large erosion features <br />on the constructed pad and outslope. Because the disturbance extended outside of the area <br />approved surface disturbance, $750 is assessed for seriousness. <br />FAULT <br />A high degree of negligence is apparent from the fact that material placed on the pad by <br />the operator apparently caused the problem cited in this NOV by prohibiting surface runoff <br />from being diverted to where it was planned to go. $750 is assessed for seriousness. <br />GOOD FAITH <br />There is no evidence in the file to indicate that the NOV has been abated or terminated. <br />Good faith is not relevant at this time. <br />C:\WP51\060696 <br />
