Banta, Director <br />Mined Land Reclamation Division <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Dear Mr. Banta: <br />This letter is the response of Blue Flame !Sine, Permit <br />No. C-81-053, to your letter dated July 30, 1990. For the reasons <br />discussed below, Blue Flame Coal Company strongly disagrees with <br />your conclusion that there is a pattern of violations justifying a <br />show cause order under Rule 5.03.3. Blue Flame Coal denies that <br />the violations noted in your July 30, 1990 letter were caused by <br />the unwarranted failure of Blue Flame Coal to comply with the <br />requirements of the Colorado Surface Coal Mining Reclamation Act or <br />the Rules or that Blue Flame Coal willfully caused any of the <br />violations. To the contrary, Blue Flame Coal believes that the <br />record in the present case demonstrates that Blue Flame Coal has <br />acted in good faith and has taken every measure possible to comply <br />with the Act and the Rules. <br />For example, pour letter makes note of violations regarding <br />drainage and sediment control concerns. Blue Flame Coal believes <br />that it has taken every step possible to abate these violations as <br />soon as possible after receiving the notice of violations. It has <br />taken considerable measures to construct the sediment pond in <br />accordance with the approved plans, and believes that this <br />situation will be completely resolved this week. The considerable <br />remedial actions taken by Blue Flame Coal do not show an <br />unwarranted failure of Blue Flame Coal to comply with requirements, <br />but, to the contrary, show Blue Flame Coal's good faith in taking <br />actions to comply with all requirements. There is no evidence <br />that any of the cited violations have resulted in any harm to the <br />environment. Blue Flame coal will continue to strive to comply <br />with regulations and to ensure that no harm results to the <br />environment from this mine. <br />
