<br />DEED <br />B~~x42~8PC 180 <br />CONSERVATION EASEMENT <br />This deed made this ~_ day of ~1~C1 , 1993 by <br />MOBILE PREMIX CONCRETE, INC., <br />a Colorado corporation, ("Grantor") <br />to <br />ADAMS COUNTY, <br />a body politic and corporate <br />organized and existing under the laws <br />of the State of Colorado, (the "County"). <br />Grantor is the owner of a tract of land in the County of <br />Adams, State of Colorado, situate within the area bounded by the <br />Westerly extension of 112th Avenue on the North, 104th Avenue on <br />the South, the South Platte River on the West and by Old Brighton <br />Road on the East. Grantor's land is delineated on sketch marked <br />Exhibit A, attached and a part of this Deed. <br />Included in Grantor's land is an area along the South <br />Platte River which is important in its present state as a wildlife <br />habitat, to-wit: a roosting area for American Bald Eagles. This <br />area (hereinafter the "Property") is described in Exhibit B and <br />delineated on drawing marked Exhibit C, both attached and a part of <br />this Deed. <br />The Property also is of significant conservation value <br />for certain recreational use by the public, to-wit: a foot or <br />walking trail forming a part of the South Platte River Trail <br />established or to be established and to be administered by the <br />County solely for public recreation. <br />Grantor is willing to limit Grantor's use of the Property <br />to the flowage to and from the South Platte River from and to <br />reservoirs on Grantor's adjoining land and to the ancillary <br />facilities and structures installed or to be installed from time to <br />time to handle such flowage. <br />XPX2.011 <br />Septeaber 24, 1493 <br />
