Cattany <br />Divisfnn Director <br />8120 Gage Street Natural Resource Tmstee <br />Frederick, CO 80516 <br />RE: Durham Pit -Flood Control Mitigation Plan, Meeting Summary <br />Class: Revision, Type-Seq.: TR-2, Permit No. M-1978-056 <br />Dear Chris: <br />Based on our February 1, 2006 meeting, it is the Division's understanding that Varra Companies, <br />Ina (VCI) will be completing the following measures no later than March 31, 2006 pertaining to <br />the Flood Control Mitigation Plan for the Durham Pit: A) VCI will submit an engineering <br />stability analysis that demonstrates that backfill & grading measures needed during final <br />reclamation for the flood control berm will not damage the 23001ineaz feet of gas pipeline within <br />the berm, B) VCI will submit an engineering stability analysis which demonstrates an adequate <br />factor of safety for the modified embankment during and after a major flooding event such as a <br />100 year flood, and C) VCI will submit a detailed, reclamation cost including various itemized <br />costs & volumes as previously specified by the Division or a "Bid Installation Cost" for <br />completing all final reclamation measures.
