Erickson <br />Division of Minerals and Geology <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Re: Abatement Response and Request for Extension of Abatement Time <br />Notice of Violation No. C-93-I50, Emission Permits <br />Raton Creek Mine -Permit No. C-82-055 <br />Dear Mr. Erickson: <br />13031623-8317 <br />twx 910-931-2561 <br />'RECEIVED <br />MAR U 3 1994 <br />C~ 'i^i^^~ ct Pdiner2le c (:e; <br />,,, <br />Due to reasons discussed below, Energy Fuels Mining Company (EFMC) respectfully requests an <br />extension of the abatement date for Step No. 3 of NOV C-93-150 concerning renewal of emission permits. <br />NOV C-93-47 was written for: 1) Failure to have qualified registered PE, or individual under <br />direction of same, conduct quarterly inspections of refuse pile; 2) Failure to have qualified registered PE, or <br />individual under direction of same, conduct quarterly inspections of sediment pond; and 3) Failure to <br />maintain air emissions permits. <br />EFMC has complied with above Items 1 and 2 by providing certified inspection reports for the refuse <br />pile and sediment pond, and has submitted application for air pollution permit to the Colorado Department of <br />Health (CDH) in response to Item 3. A copy of this permit application is attached hereto for reference. <br />The CDH has informed us that the emission permit application is under preliminary', review on this <br />date. They will determine if an emission permit is required For EFMC's current and proposed reclamation <br />activities at Raton Creek. <br />NOV C-93-I50 specifies renewal of emission permits for the Mine Site, Santa Fe loadouts, and the <br />Buriingtort Northern loadout. The Santa Fe loadouts currently have a valid emission permit, and the <br />Burlington loadout is completely reclaimed and under review for bond release. Only the Mine Site <br />reclamation operations are subject to applicable air statutes and regulations. <br />A complete application for Air Pollution Emission Notice has been filed with, the CDH. Based on the <br />time required for CDH review and approval of the permit application, EFMC requests an additional 60 days <br />to comply with the final step of NOV C-93-I50.
