NOTICE OF FILING APPLICATION <br />COLORADO MINED LAND RECLAMATION PERMIT AMENDMENT <br />Notice to the County Board of County Commissioners <br />Grand County <br />The Climax Molybdenum Company, Henderson Operations (Henderson) intends to apply to the <br />Colorado Mined Land Reclamation Board (NLRB) for an Amendment to its current Mining and <br />Reclamation Permit (M-77-342) for its mining and milling operation located in Clear Creek <br />County and Grand County. The attached information is being provided to notify you of the <br />location and nature of the proposed activities included in the Amendment. The entire <br />Amendment application will be on file with the Colorado Division of Minerals and Geology <br />(Division) and with the Grand County Clerk and Recorder at the time of its submittal to the <br />Division. <br />Henderson proposes to: 1) increase by net 95 total acres the affected lands area azound and <br />adjacent to its mill-site as additional buffer for construction of an interceptor canal above the <br />tailings impoundment; 2) acknowledge the future possibility that Henderson mine could be the <br />site of the National Deep Underground Science and Engineering Laboratory (OUSEL), a land <br />use accommodated under the present land use classification of "industriaUCommercial". The <br />proposed changes will not change present mining or milling operations at Henderson. Pursuant <br />to Section 34-32-116 (7)(j), CRS, the NLRB is required to confer with the local Board of County <br />Commissioners before approving the post-mining land use proposed in the Amendment. <br />Accordingly, the NLRB would appreciate your comments on the proposed Amendment. Please <br />note that, in order to preserve your right to a hearing before the NLRB on this application, you <br />must submit written comments on the application within twenty (20) days of the date of the last <br />publication on the notice pursuant to Section 34-32-112 (10), CRS. <br />If you would like to discuss any issue regarding this permit Amendment application, please <br />contact the Division, 1313 Sherman Street, Room 215, Denver, Colorado 80203 (3031866-3567). <br />
