The revised Bond Release Document eliminates an incorrect <br />reference to Colorado Regulation Section 2.06.5, page 9 in the original proposed decision <br />document. Rule 2.06.5 applies to steep slope mining which does not apply at the Raton <br />Creek Mine site. <br />For your reference I am enclosing a copy of the proposed decision and cover letter for <br />technical revision No. 17 explaining the reason a partial approval was proposed. The <br />Division is unable to approve permanent retention of the pond light-use road until Energy <br />Fuels Mining Company has provided the appropriate demonstrations and received approval <br />from the Division for permanent retention of the sediment pond. <br />While conducting an inspection of the mine site on May 9, 1995, Mr. A.J Iuppa requested <br />that a copy of my inspection report be forwarded down as well. Please find a copy of my <br />report included in this package. <br />I am looking into your question regarding appeal processes for Office of Surface Mining <br />decisions. I will contact you as soon as I have more information. I have recently placed a <br />copy of the Colorado Surface Coal Mining Reclamation Act and Regulations on file at the <br />Las Animas County Public Library to be available for public review and information. <br />
