He stated that he put together the
correspondence for Henry Barbe of MCC, which is found in Exhibit G
of the MCC package. i asked if that was all there was because it
seems that the correspondence stops without a resolution. He did
find one additional letter dated August 22, 1985 from Anaconda to
Dale Fenwick of Grand Mesa Properties. This letter was faxed to me
on October 14, 1993. Mr. Stover stated that most likely Grand Mesa
concerns were addressed or Grand Mesa felt that the Division would
follow-up.
Mr. Stover stated the initial notice dated December 13, 1984 in
Grand Mesa's files, has written in the margin in red ink, "mining
not until August 1985". Also, contained in the files is an
Anaconda Decreed Spring map with a list of water rights dated
August 1979 (map 2.8.1.F). Mr. Stover believed that the operator
had mapped the decreed springs, as Grand Mesa had requested in
their letter of August 29, 1985.
007NOV.PH1
