Permit M82-121 <br />Dear Mr. Squire: <br />Your inspection r+apoR of 5!30!96, under the section oonoaming problems and <br />con-ecxive actions, requires that Mid~ontinent 'post an additional $6,213 financial <br />warranty Lry July 7, 1996.' <br />As you know, we are attempting to resolve our dispute with the Bureau of Land <br />Management (BLM) over the ownership of the previously mined materials so as tb <br />allow for resumption of operation at the Mid~ontinent Quany without having to await <br />the deasion of the Interior Board of Land Appeals (IBLA), before wtwm an appeal of <br />this issue is now pending. A substantial feQor in that proposed settlement would <br />be a provision which would allow Mid-Continent to post the additional bond, <br />notwithstanding the bankruptry. <br />If this dispute can be resolved through such an agreement the IBLA appeal will be <br />withdrawn; if not, then the appeal will go forward to hearing and the matter will be <br />deeded by IBLA or a couR of law. <br />Attadled is the letter we have sent BLM outlining our proposal as to the basis for a <br />sewement We are hopeful they will agree to it, end we can then proceed with the <br />steps outlined to obtain the funds necessary to provide the additional finanaal <br />warranty, as required by DMG.
