Douglas Sand and Gravel Pit No. 1, File No. 83-89
Dear Mr. Smythe:
Please consider this notification of a Formal Public Hearing of the Colorado
Mined Land Reclamation Board for reconsideration of notice of violation cease
and desist order and civil penalties found at the May 23, 1985 Colorado Mined
Land Reclamation Board meeting. I have enclosed copies of previous
correspondence which the Division had sent to you on May 29, and April 29 of
1985. This correspondence covers information regarding this matter. Please
read all correspondence carefully.
The Board set the matter for a formal Public Hearing at the July 24-25, 1985
meeting to reconsider a notice of violation, cease and desist order and civil
penalties. The meeting commences at 9:00 a.m. in Room 110, 1313 Sherman
Street, Denver, Colorado. Please call the Monday or Tuesday before the
meeting to find out the specifically scheduled day and the agenda item number
of your hearing.
Pursuant to CRS 34-32-123 and CRS 34-32-124, you are hereby given
notice that a hearing has been scheduled pursuant to the "State
Administrative Procedures Act" (APA), article 4 of title 24, CRS for
July 24-25, 1985 in Room 110 of 1313 Sherman Street, Denver, Colorado.
Please note that as per C.R.S. 34-32-124(7): "Any person who violates
any provision of any permit issued under this article shall be subject
to a civil penalty of not less than one hundred dollars per day nor
more than one thousand dollars per day for each day during which such
violation occurs; except that any operator who operates under a permit
issued under section 34-32-110 shall be subject to a civil penalty of
not less than fifty dollars nor more than two hundred dollars per day
for each day during which such violation occurs.
