This means that formal
notice will be published and mailed to interested parties, and
the parties will have a 10-day comment period to respond to the
TR application. This process provides a mechanism for formally
notifying and soliciting the input of all concerned parties, and
we have no objection to it.
However, we are also concerned that because the berm has
been an integral part of the amendment application (AM-002) which
has been processed over the last few months, some parties may be
confused and believe that they have already commented on the
merits of the berm. For that reason they may not provide
additional input to this TR process. We thus request that the
MLRB direct the DMG staff to consider, as part of its decision on
the TR application, all information relevant to the berm and its
1
Jana L.Mendez Ronald K.Stewart Paul Danish
County CommLssloner County Commtssioner County Commissioner
