SNELTON, Director <br />August 7, 1987 <br />Mr. Joe Carpio <br />La Plata Coal Corporation <br />P.0 8ox 1941 <br />Durango, Colorado 81302 <br />Re: La Plata No. 1 Mine - Stipulations 1, 5, 6 and 7; Fiie C-87-072 <br />Dear Mr. Carpio: <br />The Division has reviewed your July 17, 1987 letter addressing the referenced <br />stipulations. The submittal does not adequately address these stipulations. <br />The Findings of Compliance and Proposed Decision were forwarded to you on <br />June 1, 1987. Shortly after you received this document we discussed over the <br />telephone each of the seven stipulations. We again discussed each stipulation <br />during my inspection of this site on June 25; 1987: Once the Division's <br />proposed approval decision became final; we had a telephone discussion the <br />next day (July 8, 1987) about the above referenced stipulations. <br />As discussed, Stipulations 1; 5, 6; and 7 were all initiated once the <br />Division's approval decision became final. When the Division's decision <br />became final on July 7, 1987; it was necessary to satisfactorily resolve these <br />four stioulations within five business davs: <br />Stipulation No. 1 pertained to updating the permit application document: <br />During the adequacy review, a number of items changed from what was initially <br />submitted. Some, but not a11; of these changes were made to the application <br />documents: To insure the application documents accurately reflected all <br />changes and agreements, we imposed this stipulation. Regarding this <br />stipulation, your July 17, 1987 received letter stated "A11 permit document <br />will be updated to reflect all changes made:" This does not satisfactorily <br />address this stipulation: As discussed, replacement pages and maps are needed. <br />Stipulation No, 5 pertained to revising Map 12 and submitting support <br />information relating to post-mining topography. Revised Map 12 was submitted <br />on July 17, 1987 which will be reviewed by the Division once the required <br />support information (text and cross-sections) are submitted. <br />Stipulation No. 6 pertained to posting the required E58,200.00 bond: Your <br />letter, received July 17, 1987; stated "Bond has been submitted."
