-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV-97-022 <br />NATURE OF VIOLATION: <br />Failure to conduct coal mining operations at the West Elk Mine to <br />-prevent degradation of environmental quality: <br />- minimize disturbance to the hydrologic balance ofoff-site areas. and to the quality and quantity <br />of water in surface and groundwater systems outside the permit azea: <br />- protect the safety of the public, and to prevent adverse impacts to persons with a legal interest in <br />lands impacted by the West Elk Mine; <br />- prevent long term adverse changes in the hydrologic balance of areas outside the permit area: <br />- prevent gravity drainage of mine water, resulting in adverse offsite impact; <br />- discharge waters to an underground mine_so as to prevent adverse impacts: <br />- prevent a landslide outside the Eermit area. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT <br />SECTION(S) 34-33-102. 34-22-120(2)(1) and (u). 34-33-121(2)(g) <br />REGULATION <br />SECTION(S) 4.OI.12(7). and (9).4.05.1(1) and (4)(c). 4.05.10(2). 4.05.16.4.12(2) <br />PERMTT <br />SECTION(S) Permit C-80-007 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLES: <br />Practices and areas of the West Elk Mine involving the transfer and storage of underground mine water to <br />the Northwest Panels Sealed Sump. resulting in offsite discharge of mine waters to adiacent lands creating <br />adverse hvdrolopic impacts and landslide activity. The advetse impacts are occurring adjacent to and in the <br />Notth Fork of the Gunnison River, and at the Beaz No. 3 Mine facilities area. <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />(l) Terminate the transfer of all waters to the Northwest Panels Sealed Sumps. <br />(2) Complete removal of all waters stored in the Northwest Panels Seal Sump, in a legal manner and in <br />comQiance with all apQlicable laws and regulations. <br />(3) Provide a detailed mitigation plan to prevent the offsite discharge of mine waters, except through <br />approved and legal discharge locations. and to prevent the adverse offsite impacts to the North Fork of the <br />Gunnison River. to the adiacent land interests and to prevent public safety hazards now occurring as a result <br />of offsite discharge of mine waters and the associated landslide. <br />(4) Completely implement the mitigation plan. <br />
