Page 19 <br />Construction Materials Rule 1 <br />(2) In the event of an objection regarding the approval, denial or <br />modification of a 111 Special Operation Permit, the provisions of Pazagraph <br />1.7.1(2)(b) shall apply. <br />1.4.8 Office Consideration > 112 Reclamation Permit Application with <br />No Objections <br />(1) When a 112 Reclamation Permit application has. been filed; and <br />there are no protests or petitions for a hearing on the application submitted by <br />a party pursuant to Rule 1.7, the Office shall issue the decision to approve or <br />deny the application, as provided for ilt Section 34-32.5-115 C.R.S., no more <br />than ninety (90) days after the application was filed with the Office. The Office <br />shaIl not set a new date unless the date for consideration has been extended <br />pursuant to Subsections 1.4.1(7), (9), or (13). <br />(2) The date set for a decision on the application may be extended, <br />pursuant to Section 1.8 (unless the submitted materials satisfy Rule 1.8.1(4)). <br />Such date shall not be extended beyond ninety (90) days after the last revision <br />to the application. ate, <br />1.4.9 Office Consideration - 112' Reclamation Permit Application to <br />which an Objection Has Been Received <br />(1) If an objection, protest, or petition for a hearing on a 112 <br />Reclamation Permit Application is received by the Office from a party pursuant <br />to Rule 1.7, the Office shall set a date for consideration of the application in <br />conformity with the provisions of this Rule. Such date shall not be eazlier than <br />thirty (30) days after the last day of the public cotnment period provided for in <br />Section 34-32-114 C.R.S., and no more than ninety (90) days after the <br />application is fi7Pd withlhe Office.-Howeue~ihe-date for~onsideration maybe <br />extended pursuant to Subpazagraph 1.4.1(7), (9), or (13), or 1.8 (unless any <br />submitted materials satisfy Rule 1.8.1(4)).
