Cattany <br />Re: River Valley Resource, Amendment Approval, Permit No. M-2001-090, Revision No. AM-1 °ivision Director <br />Natural Resource Trustee <br />Deaz Mr. Tuttle: <br />On September 24, 2003 the Division of Minerals and Geology conditionally approved the Amendment application <br />submitted to the Division on June 11, 2003, addressing the following: Increase the permitted acreage from 105.41 <br />to 128.26 acres, ie: an additiona122.85 acres. The maximum disturbance of 40.0 acres at any one time and the <br />financial warranry requirement of 8270,200 will remain the same. <br />The terms of the Amendment No. 1 approved by the Division are hereby incorporated into Permit No. M-2001- <br />090. The condition of the Division approval is noted below. Please note that al] other provisions of Permit No. M- <br />2001 A90 remain in full force and effect. The required financial warranty of $270,200 has already been received. <br />Stipulation No. 1 Description <br />A reportable spill is a spill of any toxic or hazardous substance (including <br />spills of petroleum products) within the mined land permit area reportable to any <br />Division of the Colorado Department of Public Health and the Environment, the <br />National Response Center, the Colorado Emergency Planning Commission, any local <br />Emergency Planning Commission, local Emergency Planning Committee, or the State <br />Oil Inspector. The Mine Operator shall notify the Division of Minerals and <br />Geology (DMG) of a reportable spill within the mined land permit area using the <br />same timeframe required by the permit, license, notice, statute, rule or <br />regulation governing the reporting of the spill to the other appropriate agency. <br />Notice of a reportable spill shall be FAXed to: Minerals Program Supervisor, <br />Division of Minerals and Geology, FAX (303) 832-8106.
