INSPECTION REPORT <br />March 22, 1993 <br />New Elk Mine <br />Permit No. C-81-012 <br />Wyoming Fuels Company <br />10250 Highway 12 <br />Weston, Colorado 81091 <br />719-868-2761 <br />Permit has been transferred since this inspection to: <br />Basin Resources, Inc. <br />14300 Highway 12 <br />Weston, Colorado 81091 <br />719-868-2761 <br />Individuals present during the inspection: <br />Ron Thompson, Basin Resources, Inc. <br />Joe Dudash, Division of Minerals and Geology (DMG) <br />Tom Wright, Office of Surfacing Mining (OSM) <br />Russ Porter, OSM <br />This inspection was conducted for the purposes of following up <br />on the abatement of Ten-Day Notice (TDN) number 91-02-370-003 <br />TV4. <br />The weather during the inspection was sunny and mild with <br />mostly dry ground conditions. <br />The above referenced TDN was issued on 03/19;91 and contained <br />4 violations. This inspection focused on the abatement of <br />violation number 3 of 4, failure to properly design and <br />construct sedimentation ponds. As a result of the TDN, DMG <br />issued Notice of Violation (NOV) number C-91-028 citing Rule <br />4.05.6 as the regulation violated. NOV C-91-028 was <br />terminated on 02/16/93. <br />An inspection of the ponds found that 4 out of 5 were not <br />constructed to design or the requirements of Rule 4.05.6. DMG <br />had terminated their NOV without requiring the appropriate <br />abatement measures to be completed. As a result of this <br />3 <br />
