Your <br />letter requested some guidance by our staff in pursuing a resolution to the <br />previously described problems at the Trinidad Basin Mine. Upon review of this <br />situation, the Division feels that it will be necessary for you to petition <br />the i4ined Land Reclamation Board to amend the present Board order. The <br />petition should contain a request to change the redisturbed areas from their <br />present land use designations to residential land use and exclude them from <br />the permit area. It must then be proven that the disturbed area can support <br />this new designation. Once approved it may then be possible to release bond <br />on these areas. You will, of course, still be responsible for the remaining <br />reclaimed area for the remainder of the liability period. The Division is <br />willing to discuss the details of this proposal and provide input on how to <br />prepare this request. <br />In order to proceed with this proposal we feel that first it is necessary to <br />hold a meeting with Mr. Baldwin, yourself, and Division representatives all <br />present. During this meeting we can discuss our positions, exchange <br />information on what areas exactly are involved, and set a timetable for <br />resolving the issues. This meeting should be arranged ASAP, The Division <br />realizes that it is probably more difficult for you to make arrangements to <br />attend such a meeting than htr. Baldwin or ourselves. The Division can make <br />arrangements to attend this meeting anytime. It could be here in Denver, <br />Trinidad, or Colorado Springs, etc. We are also contacting Mr. Baldwin to <br />inform him of this meeting and find out when he can attend. The Division <br />would like to conduct it before the February Board meeting. This would <br />require arranging to meet by no later than February 10, 1989.
