Long, Director <br />Subject: File N~ M 97-089, "Stone Gravel Pit" 112 Application, R T B of 22 Dec 97 <br />Deaz Mr. Long: <br />Based upon the verbal report we received that your 22 Dec 97 "reason to believe a <br />violation exists" has been rescinded, regarding Daren Stone's limited exploration <br />backhoe testpits at the Stone Grave] Pit 112 Permit application site, 1 am withdrawing <br />my request for a Board Declaratory Order hearing for the 28 - 29 January 1998 Board <br />Meeting. Under the circumstances we would ask that Mr. Stone's notice of intent and <br />fee be returned as soon as possible. <br />Regarding the 20 Jan 98 written comments of Mr. Travis E. Stills, Attorney for protesters <br />Bell, Morris, and Emerson, we wish to point out that our 26 Dec 97 response to the <br />Division adequacy letter including map revisions was only clarification of the intent of <br />the mining plans. The azea affected by operations did not change, but was more <br />completely embellished to satisfy complaints that the remaining staged units of mining <br />were not adequately depicted within the shown mining area. Additional dialog, repeating <br />the same method of operation in each of the successive mining units, we thought to be <br />redundant and unnecessarily boring. We consider a month's time for reflection on the <br />clarification to be adequate for Mr. Stills, et a!.
