;_ ..
M. Boulay - 2 - November 24, 7997
4. Bear has suggested in the past that dewatering the NW Sealed Sump was the only
reliable mitigation alternative to assure that no water would flow to the Edwards
Mine and into active slide areas. Since the window of opportunity for this mitigation
measure has past, Bear suggests that MCC be required to accept total
responsibility for the mine water discharge and any damage caused by the slide.
!n order to implement this mitigation alternative, it may be necessary for MCC to
accept assignment of Bear's discharge permit and probably Bear's mining permit.
Please call if you have any questions.
Sincerely,
~~C?V2."~ '.-
J. E. Stover, P.E.
Consulting Engineer
cc: Bear Coal Company
