I ~ Exhibit "E" <br />(~ The material will be placed in the backfill by front-end loader and/or scrapers. This action <br />will stabilize the material and prevent unacceptable settling and voids. <br />(10) Any mined material - if any - to be disposed of in the affected area will be backsloped and <br />handled in such a manner as to prevent release of pollutants to the drainage system. There aze no <br />unauthorized pollutants which will be brought in or originate on site. <br />(11) No unauthorized release of pollutants to groundwater shall occur from any materials mined, <br />handled or disposed of within the permit area. Since this is a dry sand pit of mineral <br />compositions there will be no pollutants to be mined, handled or disposed of within the permit <br />azea. <br />3.1.6 Water -General Requirements <br />(1) This operation is a dry pit operation with no water requirements and no affect on water <br />quantity or quality in the drainage during and after the mining operation. The following <br />measures will have no affect on either surface or ground water systems of the drainage. <br />(a) This operation will not interfere with any Colorado water laws or regulations governing <br />. existing water rights. <br />(b) There will be no Federal or Colorado water quality laws and regulation that affect this <br />operation or water quality standazd and site specific classification and standazd adopted by the <br />Colorado Water Quality Control Commission. <br />(c) Applicable Federal and Colorado dredge and fill requirements will not be affected by this <br />operation. In operations such as this in other parts of the State, the Corps of Engineers has been <br />consistent in not requiring a 404 permit, and Colorado Water Quality Conttol Commission has <br />taken the same approach. Tha applicant has a letter from the Corps of Engineers stating that no <br />404 permit will be required. <br />(d) There will be no tempor~uy or lazge siltation structures in this operation. The throws in the <br />thread will not be affected. <br />(2) There will not be any water impoundments of any type. The operation will not affect or <br />conflict with any water pollution laws, rules or regulations of the federal government, the state of <br />Colorado or with any local government pollution ordinances. <br />(3) All surface areas of the affected land, including soil piles will be stabilized and protected so <br />as to control erosion. <br />-1 <br />
