a <br />Exhibit "E" <br />3.1.2. Reclaiming Substituted Land <br />Even though the operator owns the adjacent land, no substituted land will be reclaimed in this <br />operation. The operator has not previously abandoned unreclaimed mining lands. <br />3.1.3 Time Limit and Phased Reclamation <br />The operator will carry on reclamation with full due diligence if required by MLItB. However, <br />this will be a long term operation depending on runoff and business demand. It has already been <br />in operation for over 50 yeazs. <br />3.1.4 Public Use <br />The owner/operator does not plan on allowing any public use for recreational or any other use. <br />Mining will be done by an MSHA approved contractor, and the public will not be allowed on site <br />without a company representative. After the site has been released by the Boazd, the landowners <br />may allow public access if it is deemed beneficial. Part 46 of MSHA will be followed on this <br />site. <br />3.1.5 Reclamation Measure -Material Handling <br />(1) Grading will be carried on so as to create a final topography appropriate to the final land use. <br />However, any backsloping will probably be eroded away the first large downpour. <br />(2) There will be no overburden or waste material to use in backsloping. There will be no <br />leaching of toxic acid or acid-forming materials. <br />(3) All grading will be done in a manner to control erosion and siltation of the affected lands, to <br />protect the areas outside the affected land from slides and other damage As stated eazlier, the <br />only highwalls will be low and backsloped at 3H:1 V if required by MLItB.. <br />(4) Backfilling and grading shall be done as soon as possible after mining. Time schedule will be <br />to do the backfilling and grading as soon as operationally feasible. However it must be <br />remembered that this has been and will continue to be a long term operation. <br />
