:~ <br />-2- <br />Issue a Cease and Desist order prohibiting any mining related operations, except <br />reclamation according to the approved plan, in the area disturbed outside of the <br />approved permit boundaries until such area has been included in an approved <br />permit area. <br />Corrective Action(s): In the likely event that the area disturbed outside of the <br />permit area boundaries is included in the City of Florence's permit for the Union <br />Mil] Hil] Pit, conversion of which to a 112 permit is currently in progress, require <br />Fremont Paving and Redi-Mix to secure an agreement with the City of Florence <br />whereby Fremont Paving assumes responsibility for reclamation of the area <br />disturbed by Fremont Paving outside the Florence Pit permit area. If, for some <br />reason, the area outside the Florence Pit permit boundaries is not included in the <br />Union Mill Hill Pit permit area, require the operator to submit an amendment to <br />include those areas within his own permit area within 60 days of the decision on <br />or withdrawl of the Union Mill Hill Pit conversion application and to secure <br />approval of that amendment within 120 days of the date of its submittal. <br />CIVIL PENALTY <br />(A civil penalty cannot be issued by tl~e Board against permitted Construction <br />Material Exploration Operations, C.R.S. 34-32.5-124(7).) <br />A person who violates any provision of a permit issued under C.R.S. 34-32.5-101 <br />shall be subject to a civil penalty of not less than $100.00 per day nor more than <br />$1000.00 per day for each day during which such violation occurs. <br />If the Board chooses, they may suspend all or a portion of the civil penalty to <br />encourage timely compliance with corrective actions. <br />The Board may also suspend all or a portion of the civil penalty based nn the <br />permittee's efforts to correct the violation prior to the Board hearing. The <br />permittee has completed the following actions in order to correct the violation(s): <br />None <br />96NO162 <br />
