A cover letter <br />did not accompany the fax, but Mr. David Berry informed AFO that the NOV was <br />issued in response to the above mentioned TDN. <br />AFO has reviewed NOV C-93-009 and determined that the nature of the violation <br />and the location are the same as those listed on the TDN. The regulation cited in <br />the TDN is also referenced in the NOV. Therefore, AFO finds the NOV to be an <br />appropriate response to the TDN. However, AFO is concerned about the <br />adequacy of the abatement measures. The abatement measures appear to <br />address the submission of certifications in a future tense, while the TDN references <br />the past due certifications. AFO will continue to review this situation during the <br />oversight process.
