LOng <br />Division Director <br />On April 7, 1994 we conducted an inspection of your mine and found mining and <br />mining-related activities outside the permit boundaries. We believe this is <br />in violation of C.R.S. 34-32-109(1)(2) and (7) of the Colorado Mined Land <br />Reclamation Act and Rule 2.1 of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board or C.R.S. 34-32-110(2)(a) and Rule 3.1(1) or <br />C.R.S. 34-32-116(7)(h) and Rule 6.1(2). Therefore, we have found reason to <br />believe a violation exists to Permit M-81-277 and the Law and have scheduled <br />this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the May 25-26, 1994 Board meeting <br />for consideration of possible violation. The hearing will be held in Room 318 <br />of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon <br />thereafter as the matter can be considered and you will have the opportunity <br />to be represented and heard. It will be reiterated that there is reason to <br />believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and <br />desist order, assess a civil penalty in the amount of $50,00 to $200.00 for <br />each day of violation or order the permit be suspended, modified or revoked. <br />In addition it may set the matter for consideration of forfeiture of the <br />$2,580.00 financial warranty at a subsequent hearing.
