L • <br /> Letter to Michael Hart -2- July 31 , 1997 <br /> Board that it was the Division' s finding that the improvements to the <br /> Deepe Farm Pit perimeter levee proposed in technical revision TR-006 <br /> will not result in damage to adjoining property during flooding, and <br /> that the presence of an improved Deepe Farm Pit perimeter levee will <br /> serve to minimize flooding in developed areas north of the pit during <br /> a one percent annual chance flood event on South Boulder Creek. It <br /> follows from these findings by the Division that it is the Division' s <br /> position that improvements to the levee proposed in technical revision <br /> TR-006 will effectively minimize disturbance to the prevailing <br /> hydrologic balance, and as such, the proposed levee improvements will <br /> meet the performance standards of the Colorado Mined Land Reclamation <br /> Act at 34-32-116 (7) (b) and 34-32-116 (7) (g) . <br /> Based on these findings by the Division, it is no longer necessary for <br /> Western Mobile to provide the Division with floodplain analysis in <br /> support of technical revision TR-006, and Western Mobile is hereby <br /> absolved of that requirement . All other aspects of the Division' s <br /> adequacy review for TR-006 will have to be addressed, and as you know <br /> the process of addressing these remaining issues is already well <br /> underway. It is the Division' s understanding that you will be placing <br /> copies of the floodplain studies listed above, along with all of the <br /> other documents related to technical revision TR-006 , for public view <br /> at the offices of the Boulder County Clerk and Recorder. <br /> Thank you for your assistance in this matter, and if you have any <br /> questions, please contact me. <br /> Sincerely, <br /> U: <br /> Allen C .
