Long <br />Division Drrxlor <br />On January 1, 1995, the Division of Minerals and Geology conducted an <br />inspection of your operation and found that mining activities are <br />being conducted. There is no permit for this operation. We believe <br />this activity may be in violation of Colorado Mined Land Reclamation <br />Act, C.R.S. 34-32-101 et seo. and specifically C.R.S. 34-32-109(1) <br />and (2} for failure to obtain a reclamation permit. <br />Therefore, we have reason to believe that a violation may exist to <br />the Law and have scheduled this matter before the Mined Land <br />Reclamation Board. <br />If you wish to waive your right to a 30 day notice, the Division will <br />schedule your hearing during the January 25-26, 1995 Board meeting <br />for consideration of possible violation. The hearing will be held in <br />Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 <br />a.m. or as soon thereafter as the matter can be considered. At that <br />hearing you will have the opportunity to be represented and heard. <br />It will be reiterated that there is reason to believe that you are in <br />violation of the provision noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease <br />and Desist order, assess a Civil Penalty in the amount of $1,000.00 <br />to $5,000.00 (or $50.00 to $200.00 per day if you are found to be <br />eligible) for each day of violation.
