Notice of Possible Violation; Continued to December 13-14, 2006 MLRB Hearing

The Division of Reclamation, Mining and Safety (Division) scheduled Comstock Mining & Refining to
the October 18-19, 2006 hearing before the Mined Land Reclamation Boazd for possible violation ofthe
Colorado Mined Reclamation Act (Act) and the Hazd Rock/Metal Mining Rules and Regulations (Rules)
and the Performance Warranty for failure to demonstrate to the Division Comstock Mining & Refining's
financial ability to carry out their obligation under the article and for failure to provide a description of the
basis for legal right of entry to the site and to conduct mining and reclamation.
On September 1, 2006 a Succession of Operators and Transfer ofPermit Application was submitted to the
Division (SO-03) to transfer the permit to Harry Covey. The application is currently under review. In
order to allow Mr. Covey time to complete SO-03 and post the additional financial waEranty, the Division
will continue the item regazding the possible violations to the December 13-14, 2006 Hearing.
