The winter months precipitation <br />is in the form of snow. It is the opinion of the operator that with the limited <br />rainfall and the improbability of runoff that the contribution of sediment to the <br />streams leaving the area, if any, is not significant. <br />Notice of Violation No. 1 <br />Hubbard Creek Waste <br />The waste pile covers approximately . 25 acres and with the porous <br />surface the runoff over the surface is not significant. The waste is considered <br />non-toxic and non-acid forming. There has been little activity associated with <br />this area other than surveying for more than six years. It is our opinion that <br />we do not contribute sediment to the stream leaving the area. <br />Old Refuse Dump West of Elk Creek <br />The subject refuse dump has a porous surface and with the limited area <br />rainfall we feel that there is little, if any, contribution of sediment to the stream <br />leaving the area. <br />Notice of Violation No. 2 <br />Bear Creek Fan Area <br />The disturbed area at Bear Creek totals some 3. 2 acres with a portion <br />of the area being anon-U. S. Steel road accessing the higher mountains. This <br />substation and fan have been in place for over 15 years and the area is generally <br />stabilized. The outfall area between the disturbed areas and Bear Creek is a <br />riprap surface with considerable vegetation. It is our opinion that with the <br />limited rainfall even in a 10-year/24-hour event that the runoff from the area, <br />if any, does not contribute sediment to the stream leaving the area. <br />Hubbard Creek Fan Area <br />The Hubbard Creek Fan area which includes the mine waste pile covers <br />less than two acres of disturbance. The installation hae been in place more <br />than 10 years and is considered relatively stable. A diversion ditch intercepts <br />the runoff from the higher elevations above the fan area to preclude runoff <br />through the area occupied by the fan and substation. It is our opinion that the <br />contribution of sediment, if any, to the stream leaving the area is not significant. <br />2 <br />
