Hagen: <br />We received the above referenced Ten Day Notice on April 5, 1991. <br />The Division and OSMRE, AFO have communicated on numerous occasions regarding <br />the propriety of our bond adjustment process. The correspondence indicates <br />the we continue to disagree over these adjustments. In an effort to resolve <br />-1 this concern, I have recently suggested to you that a Rule change would <br />_,1 satisfy your concerns. We are scheduled to discuss this matter further at our <br />first quarterly meeting on April 10, 1991. <br />Given the nature and substance of our correspondence and the likelihood of <br />rule making, I do not believe that a Ten Day Notice is the proper forum for <br />resolution of this issue. The Division's bond adjustment practices are <br />clearly a programmatic issue and must be resolved as such. <br />The Division believes that the permittee is in compliance with the <br />December 7, 1990 revision approval. This is substantiated by the record in <br />that matter.
