III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Carbon Junction Mine for the month of March, 2002. <br />Availability of Records: The records were not satisfactory. The insurance document had expired and <br />the sediment pond inspection for fourth quarter 2001 could not be found. NOV CV-2002-006 is being <br />issued for failure to provide to the Division, or maintain at the site, a certificate of insurance certifying that <br />the applicant has a public liability insurance policy in place. See page 5 of this report for further details. <br />Hydroloaic Balance: All ditches, culverts and ponds were inspected. Both ponds appeared stable and <br />were not discharging. All culverts were clear and capable of functioning as designed. <br />General Mine Compliance: The site was to have commenced reclamation in the north and south pit <br />areas during the latter part of January or early February 2002, however, nothing has been done (see <br />pictures below) and indications are nothing is planned to date. Therefore, NOV CV-2002-005 is being <br />issued for failure to restore affected areas of surface mining in a Timely manner. No other problems were <br />noted on site. <br />
