Cattany <br />Division Director <br />Na[ura( Resource Trustee <br />The Division received the adequacy responses for the King Mountain Sand & Gravel Mine Conversion <br />Application (CN-01), Pennit No. M-1978-314. The Division has additional questions and comments that <br />will need to be addressed prior to approval of the revision. <br />1. Please submit proof of the public notice circulated in the newspaper. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />2. The applicant states that topsoil stockpiles will be located a minimum of 10 feet from the edge of the <br />county roads and property lines, and the intezior toe of the stockpiles will be a minimum of 50 feet <br />from the top of the mining cut. Please commit to field locating these mazkers to ensure the adequate <br />setbacks. <br />3. The applicant states, "...instead, the applicant proposes to leave the ultimate mine slopes in place by <br />only mining up to the point at which the ultimate pit boundary is reduced." Please further clarify this <br />statement. Tn addition, please commit to field locating mazkers to ensure that slopes can adequately <br />be reduced to 3hav within the affected azea. <br />4. The applicant states that a concrete plant is not expected to be need at this site, however, if needed at <br />a future time then the equipment, settling ponds and wash out basins will be located within the mining <br />limits. Please be aware that if the operator proposes a concrete plan at a futwe date, then the <br />applicant will need to address the locafion, bonding requirement, water rights and impacts to the <br />hydrologic balance under this conversion application. As an alternative, the operator can elect to <br />submit a Technical Revision at a future date for the concrete plant to address these adequacy items. <br />5. During the Division's pre-operation inspection of January 28, 2005, the Division noted large <br />quantifies of mining related debris and miscellaneous equipment stored within the expanded permit <br />area, immediately south of the existing Hewes Pit. Because this equipment is located within the <br />proposed expanded permit area, the Division will need to include a cost for removal of all items in the <br />reclamation cost estimate. Please provide an inventory of all structures, barrels and their contents, <br />and debris located on site and their associated dimensions.
