Box 120 <br />Alamosa, Colorado 81101 <br />RE: 1) Unpermitted Operations <br />2) Nichols Pit, Permit It79-167 <br />Dear Mr. Malouff: <br />This correspondence discusses several matters so that we might clear them a1Z <br />up at once. <br />1) Unpermitted Operations. We have three separate unpermitted <br />operations where evidence indicates you were the operator. <br />a. An operation in the NEr2NE'-r(, Section 4, T36N,R8W of the N.M.P.M. <br />in Coneios County. This is the operation concerning which you received a <br />letter, dated November 2, 1981, from James L. Schmieding of our staff, <br />notifying you that on December 16, 1981 the Mined Land Reclamation Board <br />would hold a hearing for the possible imposition of civil penalties against <br />you. Pursuant to our notice, which you acknowledged receiving, the hearing <br />began on December 16, 1981, and will be continued on January 27, 1982, in <br />Room 110, 1313 Sherman Street, Denver, Colorado, beginning at 9:00 A.M. or <br />as soon thereafter as the matter can be considered. <br />b. An operation known as the Gomez Pit, in Section 6, Range 2 West, <br />Township 35 North, N.M.P.M., in Archuleta County. Signed letters from two <br />individuals (see letters attached) state that during the late summer and fall <br />of 1979 a company known to them as Malouff's High Valley Paving did enter, <br />extract and process gravel at this pit. <br />As you are aware all mining operators including sand and gravel operators are <br />required to obtain mining and reclamation permits for their mining operations <br />in Colorado by the Colorado Mined Land Reclamation Act, C.R.S. 2973, 39-32-101 <br />et seq., and specifically, 34-32-109(7), as amended. <br />The Mined Land Reclamation Division has placed this operation on the Mined Land <br />Reclamation Board meeting agenda for consideration of possible violation of the <br />above mentioned statute. This meeting is scheduled for January 27, 1982, in <br />Room 1Z0, 1313 Sherman Street, Denver, Colorado, beginning at 9:00 A.M. or as <br />soon thereafter as the matter can be considered. <br />y <br />
